My first thought was either nut or bridge. If it only happens with open E string, then it is your nut. A new nut or maybe just a tree (if pressing on the string behind the nut helps) should correct it.

No matter how high the nut action is set, as soon as you press the string to a fret, the action is now from that fret to the bridge, and high frets in the path will buzz.
